In respect of the services please note for the avoidance of any doubt, Dublin Nest will not be responsible in any way for any obligations of the landlord of any particular property. It is important that the Client and the Client’s customers are aware that they will need to enter into a separate arrangement at their own risk with the landlords of the properties directly and that Dublin Nest’s sole responsibilities are set out in the scope of the services. Dublin Nest cannot be responsible for day to day maintenance of the property and the Client and the Client’s customers need to ensure that they have adequate contractual protection in this regard with the landlord directly. |

Terms for Bookings Made from 1st Nov 2018
These Tenancy Agreement Terms and Conditions, together with the Booking Details above,
set out the terms and conditions of the tenancy agreement under which we rent the room
in the property for the length of stay (as set out in the Booking Details) to you.
1. Definitions and Interpretation
1.1 In these Tenancy Terms and Conditions:
- Booking Details – the Booking Details above setting out the details of the Room, the Property, your Payments and the Length of Stay.
- Contents – the furnishings, fixtures and fittings in the Room or Flat Common Areas as listed on the inventory provided on moving in.
- Flat – the flat referred to in the Booking Details including its Contents but excluding the Service Media.
- Flat Common Areas – the Flat excluding the Room and rooms occupied exclusively by other tenants.
- Landlord – the landlord referred to in the Booking Details.
- Length of Stay – the period from the Check-In Date to the Check-Out Date specified in the Booking Details.
- Housing Act 1988 – the Housing Act 1988 (as amended by the Housing Act 1996).
- Payment Schedule – the schedule of payments and dates listed in the Booking Details.
- Property – the building identified in the Booking Details where the Room, Flat and common areas are located.
- Property Common Areas – entrance hall, stairs, corridors, laundry, courtyard, lifts, bicycle store and any other shared areas.
- Regulations – regulations introduced to ensure safety, security, cleanliness and proper management of the Property.
- Rent – the amount stated as the Payment Total in the Booking Details.
- Room – the room referred to in the Booking Details including its Contents but excluding Service Media.
- Service Media – heating systems, electrical systems, drainage, water services and data or phone services.
- Special Conditions – any special conditions listed in the Booking Details.
- Tenancy Agreement – the tenancy agreement constituted by the Booking Details together with these terms and conditions.
Unless stated otherwise, all terms defined in the Booking Details have the same meanings in these Terms.
The expression Landlord includes successors in title and any person entitled to receive rent.
“We”, “us” and “our” refer to the Landlord. “You” and “your” refer to the Tenant.
Any obligation not to do something also requires taking reasonable steps to prevent others doing it.
If a party consists of more than one person, obligations are joint and several.
Headings are for convenience only and do not affect interpretation.
This Tenancy Agreement is an Assured Shorthold Tenancy under the Housing Act 1988.
If the agreement is signed while you are under 18, it will operate as a licence to occupy until you reach 18.
A reference to writing includes email.
2. The Letting
We let the Room to you for the Length of Stay subject to the Booking Details and these Terms.
Your rights include:
- Use of the Property Common Areas and Flat Common Areas.
- Access to the Room via the designated access areas.
- Use of shared facilities within the Flat Common Areas.
We reserve the right to enter the Room or Flat with reasonable written notice
(except in emergencies) for inspections, repairs or viewings.
We also reserve rights relating to utilities and service media passing through the property.
Conditions of the Tenancy
- You remain a full-time student during the Length of Stay.
- You are not in breach of any previous tenancy with us.
- You have no unspent criminal convictions.
If these conditions are breached you will be in breach of the Tenancy Agreement.
3. Our Obligations
If you pay the Rent and comply with the agreement, you may peacefully enjoy the Room during the Length of Stay.
We will:
- Maintain and repair the structure of the Property.
- Maintain and clean the Property Common Areas.
- Maintain Service Media serving the Flat.
- Provide hot and cold water, heating and electricity.
- Provide security facilities.
- Maintain equipment in shared areas.
We may temporarily move you to alternative accommodation if necessary for emergency repairs
or management reasons, provided the alternative is of a similar standard.
4. Your Obligations
You agree to:
- Accept the Room and Property in good condition unless defects are reported within 48 hours.
- Confirm the inventory contents within 48 hours of moving in.
- Provide a council tax exemption certificate within the required timeframe.
- Comply with Special Conditions and Regulations.
- Pay Rent and all other payments according to the Payment Schedule.
Late payments may incur interest and administration fees.
5. Maintenance Responsibilities
You must maintain the Room and Contents in good condition (allowing for fair wear and tear).
You must notify us of damage and ensure appliances comply with relevant safety standards.
You may be required to contribute to repair costs where damage occurs.
6. Tenant Conduct
The Room may only be used for residential purposes.
You must not:
- Sublet or share occupation.
- Run a business from the Room.
- Use the Property for illegal or immoral purposes.
- Smoke in the Property.
- Keep prohibited substances or weapons.
- Tamper with fire safety equipment.
- Keep animals.
- Install external aerials or satellite dishes.
You are responsible for the behaviour of your guests.
8. When You Leave
- Return keys by 10am on the final day of the tenancy.
- Pay any reasonable costs incurred in recovering possession or unpaid rent.
9. Your Deposit (if applicable)
If a Deposit is required, it will be held as security for your obligations under the Tenancy Agreement.
The deposit will be protected by an approved Tenancy Deposit Protection Scheme and confirmation
will be provided within the required timeframe.
10. Advanced Rent
Where applicable, Advanced Rent is a prepayment applied toward the first rent instalment.
Failure to pay Advanced Rent may result in termination of the Tenancy Agreement.
11. Agreements and Declarations
The Landlord may terminate the Tenancy Agreement prior to commencement if certain conditions apply,
including outstanding debts or breach of company policies.
After the tenancy starts, breaches such as unpaid rent or illegal behaviour may lead to court action
for repossession under the Housing Act 1988.
12. Failure to Check In
If you fail to take occupation within 14 days of the Check-In Date without acceptable explanation,
the tenancy may be treated as surrendered and the room may be remarketed.

14. Guarantee
The Guarantor guarantees payment of Rent and compliance with the Tenancy Agreement.
15. Data Protection

16. Severability
If any part of this Tenancy Agreement is found invalid or unenforceable,
the remaining provisions will remain in effect.
17. Notices
Notices may be served to the Landlord at:

Notices to the Tenant will be sent to the Room address listed in the Booking Details.
18. Jurisdiction
This Agreement is governed by Irish law.
The Irish courts have exclusive jurisdiction over any disputes arising from it.
